WRONGFUL CONVICTIONS & EXONERATIONS
People v. David Ramirez-Martinez
Murder Conviction Reversed — Charges Dismissed — Client Released
Mr. Johnson obtained reversal of a cold-case first-degree murder conviction after demonstrating that the trial court improperly excluded critical evidence identifying an alternative suspect.
Following reversal by the appellate court, the client was released on bond pending retrial. The State subsequently dismissed the first-degree murder charges, resulting in his immediate release.

DNA Exoneration — Client Released After More Than Ten Years in Prison
In post-conviction proceedings challenging a sexual assault conviction, Mr. Johnson pursued litigation that resulted in DNA testing unavailable at the time of trial.
The testing conclusively excluded the client as the perpetrator. The conviction was vacated and the client was released after serving more than a decade in prison.
This matter became one of the first DNA-based exonerations in Illinois.
Ryan Ferguson Habeas Corpus Proceedings (Missouri)
Habeas Relief Granted — Convictions Vacated — Client Released
During habeas corpus proceedings arising from a wrongful murder conviction, Mr. Johnson’s cross-examination of the State’s lead investigator exposed a significant Brady violation involving suppressed exculpatory evidence.
Relying in part on those constitutional violations, the Missouri Court of Appeals granted habeas relief, vacated the convictions, and ordered the client’s release after nearly ten years of incarceration. The State later dismissed all charges.
This matter illustrates the critical role of constitutional litigation and post-conviction investigation in uncovering wrongful convictions.

People v. David Brokus
Murder Conviction Reversed — New Trial Secured — Charges Dismissed
On direct appeal, Mr. Johnson obtained reversal of a first-degree murder conviction based on significant due process violations occurring during trial.
Following remand, he continued to represent the client through retrial proceedings. During jury deliberations, the State dismissed the murder charge, resulting in the client’s release without additional incarceration.

Post-Conviction Relief Granted — Conviction Overturned — Client Released
Mr. Johnson established ineffective assistance of counsel after demonstrating that trial counsel failed to present independent forensic expert testimony concerning cause of death.
Applying Strickland v. Washington, the appellate court granted relief, resulting in reversal of the conviction and the client’s release.

After conviction, Mr. Johnson successfully argued on appeal that law enforcement officers unlawfully entered a private residence without sufficient constitutional justification.
